The society took up 1st venture, acquired 90 acres of land in S.No.145, Hydernagar village, R.R Dist, in the year 1980, got the layout approved, in the year 1987, allotted plots to members and helped members for obtaining loans and to construct the houses. Thus the Vasanth Nagar colony emerged in Kukatpally and has become one of the model housing colonies in the twin cities.

The society acquired under venture II about 65 acres of land in S.No.l63.Hydernagar village R.R. district from M/s shalivahana Builders pvt.ltd., The land was got assigned through A.P. High court in Appln No 216/87 in CS14/58 dated 13-05-1987 and Appln No 249/89 in CS14/58 dated 9-06-1989 for two bits of land.

The warrant possession was got executed by Dist Judge R.R.District in E.P No.18/87 on 13-11-1987,and E.P.NO 9/90 as per the direction of Hon’ble High court of AP. Preparation of Project report for development of venture II was entrusted to M/s Shalivahana Builders.

Govt in its Memo No:1278/JA3/86-28,Revenue dated 24-06-1989 confirmed that the lands in S.No: 145 & 163 are not Govt lands, and directed the collector( RR Dist) to mutate the land in the name of the societies. The society filed WP16711/89 to implement the government memo and it was accepted. As the above said orders were not honoured, the society filed contempt case No 50/90 before the Hon’ble High court. M.R.O (Balanagar) Vide Proceeding No.B/1057/93 dated 23-06-1995 mutated the land in the name of the Society. M.R.O again issued show cause notice for cancellation of the mutation order. The society again approached the Hon’ble High court with another contempt petition bearing No.348/93 for the stay of the show cause notice . The Hon’ble High court reprimanded the MRO and directed him for compliance of court orders. The MRO submitted compliance report by implementing Faisal Patty.

Govt of Andhra Pradesh gave clearance for 50 acres of land in phase II for conversion of land use from conservation to residential purpose vide Lr.No:1810-1(1)/87-5 MA, MA & UD Dep’t Dt. 24-10-1989 through HUDA and letter of confirmation of the conversion is received by the society on 21-09-1994. Developement work is under progress. Road cutting work and banking is completed. Road work is ready for metalling after laying water lines. Demarcation of roads & plots is completed. Block demarcation is carried out to change all plots uniformly to about 300 Sq yards.

 

Trench cutting for laying water lines has been completed.Water lines are ready in the site for about 5600 Sq meters. Bore well is dug.Underground reservoir is completed. Over head tank columns are raised. construction of office building is completed.

Govt also exempted the society from the conditions of surrendering 10% of land,free of cost to HUDA and payment of Rs.4/- per square meter towards green belt charges. As per orders of M.A.&UD Dep’t,layout plan has been submitted after payment of processing charges and development charges at the rate of Rs.1/- per square meter as per revised order and the layout has been submitted. The M.R.O,Balanagar wrote to HUDA to withhold the release of layout and further proceedings as land grabbing cases are pending in Spl.Court.

Land grabbing cases were filled by RDO,chevella against the society LGC 1/90(Survey No 145) against Vasanth Nagar and 6/90 against 2nd Venture (Survey No 163). An interiminjunction petition was filed by the Govt pleader on behalf of RDO on 13-04-1995 restraining the society from changing the nature and character of land in Sy.No.163 and 145. Hon’ble Court appointed a commissioner to inspect the land and submit a report along with photographs.

Commissioner submitted report along with photographs, stating that 90% houses were constructed in S.No.145 (Venture I) and that as a result of status quo orders the development work in venture II could not be completed. The Hon’ble LGC Court gave judgment in favour of society, and it was confirmed by Hon’ble High Court and also Supreme Court. The Govt of AP issued memo No.28908/JA1/2004-1,dt.5-11-2004 directing the revenue authorities to mutate the land in favour of the concerned parties.Accordingly as per the direction of COllector, M.R.O confirmed and mutated the land to execute 50 acres of land in favour of the society in the yeur 2005 in addition to the 15 acres which were already mutated in the year 2002.

The society filed injuction petition in O.S.No.179/2003 in the lower court, Ranga Reddy District, which was rejected. After dismissal of suit for injunction an appeal filed by the society in the Hon’ble High court is also rejected. A Review petition is allowed by setting aside the earlier order and posted fresh hearing against tne Judgement of Ranga Reddy District court.

Mean while some of the persons who are claiming through their assignment deed executed by GPA of cyrus investments Pvt.Ltd., went to court claiming land After prolonged litigation the society compromised with Cyrus investments Pvt.Ltd. by foregoing seven Acres of land and the final decree was passed and it was registered in favour of the society by Registrar of Hon’ble High court after paying requisite stamp duty Rs.4,93,64,000/-etc.,in S.R.O Kukatpally Vide doc.No.1809/3011.

The proposed action will enable formation of unit 2 society with second venture members who land cost and developement charges
